Federal High Court Dismisses Suit Challenging Ola Olukoyede’s Appointment as EFCC Chairman

The Federal High Court in Abuja has dismissed a suit seeking to remove Mr. Ola Olukoyede from his position as Chairman of the Economic and Financial Crimes Commission (EFCC). The ruling, delivered by Justice Obiora Egwuatu, concluded that the applicant, Mr. Victor Opatola, lacked the legal standing (locus standi) to file the case.

Mr. Opatola, an Abuja-based lawyer, had challenged President Bola Tinubu's appointment of Olukoyede, arguing that Olukoyede did not meet the required years of service mandated by law for the EFCC Chairman's office. The suit named the President of Nigeria, the National Assembly, the Attorney-General of the Federation (AGF), and Olukoyede as the 1st to 4th respondents, respectively.

The respondents, including Olukoyede who was represented by Senior Advocate of Nigeria Olumide Fusika, contended that the suit lacked merit and requested its dismissal. Olukoyede maintained that he was highly qualified for the position, having served as the EFCC's Secretary, a Level 17 position, which is senior to an Assistant Commissioner of Police, a Level 14 position.

After hearing arguments from all parties, Justice Egwuatu reserved judgment until Wednesday. The key issues raised by Mr. Opatola included whether Olukoyede's appointment met the criteria outlined in Section 2(1)(a) of the EFCC Act 2004, specifically regarding the required rank and years of experience.

Ultimately, Justice Egwuatu dismissed the suit, upholding the legality of Olukoyede's appointment and affirming his qualifications for the role of EFCC Chairman.
