Court Denies Abba Kyari Bail Again, Clears Way for NDLEA Prosecution

Abba Kyari

The Federal High Court in Abuja has rejected a fresh bail application from Deputy Commissioner of Police, DCP Abba Kyari, who faces charges of drug trafficking. Justice Emeka Nwite, delivering the ruling on Wednesday, emphasized that Kyari failed to demonstrate exceptional circumstances justifying his release pending trial. The court cited its earlier dismissal of a similar bail plea and reaffirmed the need for accelerated proceedings.

Kyari, formerly of the Police Intelligence Response Team, had sought release for participation in his mother's burial, previously granted temporarily. However, the court's latest decision permits the National Drug Law Enforcement Agency (NDLEA) to proceed with prosecution alongside Kyari's co-defendants.

In a related development, Justice Nwite had earlier barred journalists from covering the trial, citing witness protection concerns raised by the NDLEA. This order was in response to the agency's plea to safeguard the identities of involved officers amidst heightened sensitivity surrounding the case.

Efforts by Kyari's legal team to challenge the charges on procedural grounds were previously dismissed by the court. The NDLEA alleges Kyari and his team tampered with seized cocaine, contrary to the law. Despite multiple bail applications, both the trial court and the Court of Appeal have upheld Kyari's remand, underscoring the gravity of the allegations and the ongoing legal battle.
