A Federal High Court in Abuja has mandated Edo Deputy Governor Godwins Omobayo to appear in person on November 26 over an alleged contempt of court order. Justice James Omotosho issued this ruling to ensure Omobayo has a fair hearing in response to a contempt charge filed by reinstated Deputy Governor Philip Shaibu. Shaibu contends Omobayo failed to vacate the deputy governorship position following a valid court order reinstating Shaibu.
The court’s initial judgment, delivered on July 17, nullified Shaibu’s impeachment by the Edo House of Assembly on grounds of due process violations, declaring the impeachment allegations legally baseless. Shaibu’s complaint, referenced under suit FHC/ABJ/CS/478/2024, names the Inspector-General of Police, the Edo Attorney General, the Chief Judge of Edo, and the Edo House of Assembly as defendants.
The court previously granted Shaibu’s motion for a substituted service to deliver Form 49 to Omobayo. However, on Monday, Omobayo and representatives for several defendants were absent, leading Shaibu’s counsel, Ayotunde Ogunleye, SAN, to request Omobayo’s court appearance to uphold judicial integrity. Justice Omotosho adjourned proceedings to November 26, emphasizing the need for Omobayo’s presence to allow him the opportunity for defense, aligning with constitutional provisions for a fair hearing.
As noted by the News Agency of Nigeria (NAN), Edo’s current administration’s term will conclude on November 12, ahead of the next court date.
